Terms of Service

1Acceptance of these terms

These Terms of Service ("Terms") are a binding agreement between you ("you") and LakeSide Software Dev, Inc., a Delaware corporation ("FinPal," "we," "us," or "our"), covering your use of the FinPal application and website (together, the "Service").

By creating an account or using the Service, you confirm that you have read, understood, and agree to these Terms. If you do not agree, please do not use the Service.

2What FinPal is

FinPal is a personal finance planning tool. It helps you:

  • Build personalized debt payoff plans and strategies.
  • Run a connected budget (MyBudget) that feeds your real cash flow into your plan.
  • Forecast and analyze investments.
  • Track progress, set goals, and get reminders.
  • Use educational tools and free calculators.

Its results come from our own deterministic algorithms, not artificial intelligence, working from the information you enter.

FinPal is a calculator and planner. It never connects to your bank or card accounts, never moves or holds your money, and is not a bank, lender, or broker. You always act on your own finances yourself.

3Eligibility and your account

Eligibility

You must be at least 18 years old to use FinPal. By using the Service, you confirm that you are.

Your account

When you create an account, you agree to:

  • Provide accurate, current, and complete information, and keep it up to date.
  • Keep your password secure and not share your account.
  • Take responsibility for activity that happens under your account.
  • Tell us promptly if you suspect any unauthorized use.

4Plans and payments

Free and paid plans

FinPal offers a free plan and paid ("Seed") plans. The current features and prices are shown on our pricing page.

Billing

  • Paid plans are billed through Stripe, our payment processor.
  • Subscriptions renew automatically until you cancel.
  • We charge your payment method at the start of each billing period.
  • You can cancel anytime in your settings; cancellation takes effect at the end of the current period.
  • We do not provide refunds for partial billing periods.
  • Prices may change, with at least 30 days' notice before a change affects you.

5Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any law.
  • Infringe the intellectual property or other rights of FinPal or anyone else.
  • Access other accounts, or our systems, without authorization.
  • Interfere with, disrupt, or overload the Service or its infrastructure.
  • Use bots, scrapers, or automated methods to access the Service without our permission.
  • Reverse engineer, decompile, or try to extract our source code or algorithms.
  • Remove, obscure, or alter any legal notices in the Service.
  • Upload or transmit viruses, malware, or other harmful code.
  • Impersonate anyone, or misrepresent your affiliation with any person or entity.

6Your data

How we collect, use, and protect your information is set out in our Privacy Policy. By using FinPal you agree to that policy, including our use of anonymized, aggregated data to run and improve the Service. We never sell your data, and your financial data is never sent to an AI model.

7Intellectual property

Our ownership

The Service and everything in it, including the text, design, logos, software, and the algorithms behind it, belongs to FinPal and is protected by copyright, trademark, and other intellectual-property laws.

Your license

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial use under these Terms. This license does not let you:

  • Resell or commercialize the Service.
  • Modify the Service or create derivative works from it.
  • Copy content except as we specifically permit.
  • Use data mining, scraping, or similar methods.

8Disclaimers

Provided "as is"

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

No guaranteed results

We do not promise any specific financial outcome. Results depend on the accuracy of what you enter, how closely you follow your plan, market conditions, and circumstances outside anyone's control.

Not professional advice

FinPal is not a licensed financial adviser, accountant, or attorney, and its output is informational and educational. Consult a qualified professional before making significant financial decisions.

9Limitation of liability

To the maximum extent permitted by law, FinPal will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising from:

  • Your use of, or inability to use, the Service.
  • Any financial decisions made based on the Service.
  • Any unauthorized access to your information.
  • Any interruption or discontinuation of the Service.
  • Any bugs, viruses, or harmful code, or any errors in content.

To the maximum extent permitted by law, FinPal's total liability to you will not exceed the greater of the amount you paid FinPal in the 12 months before the claim, or one hundred dollars ($100).

10Indemnification

You agree to indemnify and hold harmless FinPal and its officers, directors, employees, and affiliates from any claims, damages, losses, or costs (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, your violation of anyone's rights, or financial decisions you make based on the Service.

11Termination

By you

You can close your account anytime from your settings, or by emailing legal@finpalapp.com.

By us

We may suspend or end your access if we reasonably believe you have violated these Terms, harmed other users or FinPal, or broken the law.

What happens next

  • Your right to use the Service ends.
  • We delete your data as described in our Privacy Policy.
  • You are not entitled to a refund for unused subscription time.
  • Provisions that should survive termination (such as liability and IP) continue to apply.

12Changes to the Service and these terms

We may modify, suspend, or discontinue parts of the Service at any time. We may also update these Terms. When we make material changes, we will post the new version here, update the "Last updated" date, and email you. Continued use of the Service after a change means you accept the updated Terms.

13Governing law and disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules.

Any dispute will first be addressed through good-faith negotiation. If that does not resolve it, the dispute will be settled by binding arbitration under the rules of the American Arbitration Association.

14Other terms

These Terms, together with our Privacy Policy, are the entire agreement between you and FinPal regarding the Service, and replace any prior agreements.

If any provision is found unenforceable, the rest stay in effect. Our not enforcing a right is not a waiver of it. You may not transfer these Terms or your account without our written consent; we may assign them as part of a business transfer.
